PUCKPUCK operates exclusively as a Business-to-Business (B2B) custom apparel manufacturer. We do not sell products directly to individual consumers for personal use. Our services are intended solely for:

Hockey brands and equipment companies
Hockey clubs, teams, and academies
Sports retailers and distributors
Corporate sponsors and promotional partners

2.2 Made-to-Order Products

All products displayed on this website, including but not limited to:

Sublimated hockey jerseys
Embroidered hockey jerseys
Hockey socks and pant shells
Hoodies and training garments
Fan merchandise and accessories

are custom-manufactured to order based on client specifications. We do not maintain retail inventory. Product images, mock-ups, and renders shown on this website are illustrative examples of our manufacturing capabilities and may not represent actual finished products.

3. Intellectual Property Rights

3.1 PUCKPUCK Intellectual Property

All content on this website—including text, graphics, logos, images, product designs, technical specifications, and underlying software—is the exclusive property of Xuchang Chisu Sports Goods Co., Ltd. and is protected by:

3.2 Client-Provided Intellectual Property

The client represents and warrants that they own or have obtained all necessary rights, licenses, and permissions to use such intellectual property.
The client grants PUCKPUCK a limited, non-exclusive license to use such materials solely for the purpose of fulfilling the manufacturing order.
PUCKPUCK assumes no liability for trademark infringement, copyright violation, or unauthorized use of third-party intellectual property provided by the client.
The client agrees to indemnify and hold harmless PUCKPUCK from any claims, damages, or legal expenses arising from the use of client-provided intellectual property.

3.3 Design Similarity Disclaimer

While PUCKPUCK employs professional designers and rigorous quality control, we cannot guarantee that custom designs will not inadvertently resemble existing designs in the marketplace. Clients are responsible for conducting their own trademark and copyright clearance searches before finalizing designs.

4. Product Representation & Accuracy

4.1 Color & Appearance Variations

Due to the nature of digital displays, sublimation printing, and fabric dyeing processes:

Colors displayed on this website may differ from actual product colors.
Sublimation colors may vary slightly between production batches.
Fabric textures and finishes may appear differently in photographs than in person.

We strongly recommend clients request physical color swatches and fabric samples before placing bulk orders.

4.2 Size & Fit Disclaimer

PUCKPUCK designs products using North American sizing standards. However:

Sizing may vary between different product styles and fabric types.
Custom measurements provided by clients are manufactured to specification; PUCKPUCK is not responsible for sizing errors resulting from incorrect client measurements.
We recommend ordering sample garments to confirm fit before bulk production.

4.3 Product Specifications

Technical specifications, fabric descriptions, and performance claims (e.g., moisture-wicking, quick-dry, durability) are based on manufacturer testing and industry standards. Actual performance may vary based on usage conditions, care practices, and individual factors.

5. Limitation of Liability

5.1 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PUCKPUCK SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Lost profits, lost revenue, or lost business opportunities
Damages arising from delays in production or shipping beyond our reasonable control
Product defects caused by client-provided designs, materials, or specifications
Damages resulting from improper use, care, or maintenance of products

5.2 Liability Cap

In no event shall PUCKPUCK's total aggregate liability exceed the total amount paid by the client for the specific order giving rise to the claim.

5.3 Force Majeure

PUCKPUCK shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

Natural disasters (earthquakes, floods, typhoons)
Pandemics, epidemics, or public health emergencies
Government actions, trade restrictions, or export/import bans
Labor strikes, factory shutdowns, or supply chain disruptions
Carrier delays, port congestion, or customs hold-ups

6. Warranty Disclaimer

6.1 No Express Warranty

EXCEPT AS EXPRESSLY STATED IN A SIGNED WRITTEN AGREEMENT, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

6.2 Disclaimer of Implied Warranties

PUCKPUCK EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO:

6.3 Manufacturing Defects

PUCKPUCK warrants that products will be manufactured in accordance with the approved specifications and industry-accepted quality standards. This limited warranty covers:

Material defects existing at the time of manufacture
Workmanship defects in stitching, printing, or construction

This warranty does NOT cover:

Normal wear and tear from athletic use
Damage from improper washing, drying, or care
Alterations or modifications made after delivery
Color fading due to prolonged sun exposure or bleach use

7. Custom Product & Order Terms

7.1 No Returns or Exchanges

Because all PUCKPUCK products are custom-manufactured to client specifications:

NO RETURNS are accepted for reasons of fit, color preference, or change of mind.
NO EXCHANGES are permitted for custom-sized or custom-designed products.
NO REFUNDS will be issued for orders cancelled after production has commenced.

7.2 Production Approval Process

Clients are required to approve:

Design mock-ups and artwork proofs
Size charts and measurement specifications
Fabric and color selections

Once approved in writing (email confirmation accepted), the client assumes responsibility for any errors in the approved materials.

7.3 Reproduction Policy

If products do not conform to the approved specifications due to PUCKPUCK manufacturing error, we will, at our sole discretion:

Reproduce and reship the non-conforming items at our expense, OR
Issue a proportional credit for the defective portion of the order

Claims must be submitted within 14 calendar days of delivery with photographic evidence.

If negotiation fails, disputes shall be submitted to binding arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC) in accordance with its rules. The arbitration shall be conducted in English in Beijing, China.

9.3 Waiver of Class Actions

By using our services, clients agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or collective arbitration.

10. Compliance & Certifications

10.1 BNQ Certification

PUCKPUCK holds BNQ (Bureau de normalisation du Québec) Certification valid from 2025 to 2027. This certification applies to specific product categories as documented. Certification details are available upon request.

10.2 Export Compliance

All international shipments are subject to:

Export control regulations of the People's Republic of China
Import regulations of the destination country
Applicable trade agreements and sanctions

Clients are responsible for ensuring their orders comply with all applicable import laws and regulations in their jurisdiction.

10.3 Product Safety

Our products are manufactured for athletic and recreational use in ice hockey and related sports. They are not intended for:

Use as protective equipment (our products are apparel, not protective gear)
Contact sports other than ice hockey without proper assessment
Use by individuals with medical conditions that may be aggravated by athletic activity

11. Indemnification

Clients agree to indemnify, defend, and hold harmless PUCKPUCK, Xuchang Chisu Sports Goods Co., Ltd., and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

Client's breach of these terms
Client's misuse of products
Client's violation of any third-party rights
Client's violation of applicable laws or regulations

12. Severability

If any provision of this Legal Disclaimer is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
